1. Scope
These Terms of Service ("Terms") govern all contractual relationships between SG Agency LLC, operating the brand Melonia ("Melonia," "we," "us"), and its customers regarding the purchase of products offered on melonia-song.com. Placing an order implies full and unreserved acceptance of these Terms.
2. Products
Melonia sells personalized, AI-generated songs created from the details you provide in our brief form. Each song is a digital product delivered electronically. Because every song is custom-made for you, descriptions and previews are provided in good faith but the final creative result may vary.
3. Prices
Prices are displayed in US dollars (USD). Melonia reserves the right to change prices at any time, but orders are billed at the price in effect at the time the order is placed.
4. Orders
To place an order: (1) complete the brief form describing your song, (2) submit your contact details, (3) proceed to checkout, (4) complete payment. An order confirmation is sent by email. Melonia reserves the right to cancel any order in the event of non-payment, incorrect information, or any other legitimate reason.
5. Payment
Payment is processed through the secure methods offered at checkout. Transactions are protected by SSL encryption to ensure the confidentiality of your data.
6. Delivery
Songs are digital products delivered electronically by email, and where applicable by SMS, to the contact details provided at order. Delivery times depend on the option selected at checkout (for example, 30-minute or 48-hour delivery). No physical item is shipped.
7. SMS / Text Messaging Program
By providing your phone number on melonia-song.com when ordering a personalized song, you agree to receive transactional text messages from Melonia related to your order, including a link to preview your song and a link to download your completed song.
Program name: Melonia Order Notifications.
Types of messages: Transactional notifications tied to your specific order (preview link and song delivery link).
Message frequency: Up to 3 messages per order. This is not a recurring or marketing program.
Message and data rates may apply.
HELP: Reply HELP for assistance, or contact us at hello@melonia-song.com.
STOP: Reply STOP at any time to unsubscribe. After you reply STOP, we will send one confirmation message and you will receive no further texts from this program.
No mobile information (including phone numbers collected for SMS) will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be shared with any third parties. Carriers are not liable for delayed or undelivered messages.
8. Cancellations and Refunds
Because our products are custom-made digital goods created specifically for you, they are generally exempt from the standard right of withdrawal once production has begun. If you are not satisfied with your song, contact us at hello@melonia-song.com: we are happy to revise or re-generate your song to better match your brief.
9. Warranty and Liability
Melonia provides its products in good faith and cannot be held liable for any indirect damages related to the use of its products. Nothing in these Terms limits any rights you may have under applicable law.
10. Intellectual Property
All elements of the site (text, images, graphics, logo, etc.) are protected by intellectual property laws. Any reproduction or use without written authorization is strictly prohibited.
11. Personal Data
Personal data collected is used in accordance with our Privacy Policy, available at https://melonia-song.com/policies/privacy-policy. You have the right to access, correct, or delete your data. Contact us at hello@melonia-song.com to exercise your rights.
12. Governing Law and Disputes
In the event of a dispute, the parties will first seek an amicable resolution. Failing that, the dispute will be handled in accordance with applicable law.
